Encrypted Quantum Sweep Cuebids

Consider an auction like the following

W
N
E
S
1
P
1
P
3
P
4

4D is described as follows: If South holds the A and K of trump, then 4D says, "I have a club control and deny a diamond control", but if South does not hold them both, then 4D says, "I don't have a club control but I do have a diamond control."

First, is it ACBL legal? I think so, above 2N, second round of bidding. Similarly, is it alertable? And here I would think not. Is it a pre-alert? I am bothered that if the opponents aren't aware of what is going on, they may not act in their best interest. Even if the bidding is described before the opening lead, the opponents missed their bidding opportunities.

Second, does it work? The premise is that if South is slamming, he "usually" either has at least one of the top trump honors, or a bunch of outside cards and North has one of the tops. Subsequent keycard blackwood will avoid bidding slam off both the A and K. No, it may not always work in that keycard may get the partnership too high on distributional hands. It seems like a question of risk versus reward.

Third, can this idea be improved upon? (That should be an opening some of my Bridge Winner "friends" can have fun with.)

Just something to ponder on a snowy (yes, 8 inches expected) Sunday morning.
